Effective: Last updated:
This policy explains what personal information we collect through this website, why we collect it, who we share it with, how long we keep it, and the rights you have over it under Thai law.
Who we are
This website is operated by GoITExpress Phuket Co., Ltd., which trades as Digital Momentum. Digital Momentum is a brand operated by GoITExpress Phuket Co., Ltd. References to "we", "us" and "our" in this policy mean GoITExpress Phuket Co., Ltd..
We are based in Phuket, Thailand. For any question about this policy or about the personal data we hold, contact us at info@digitalmomentumth.com.
Information we collect
When you submit the enquiry form we collect the details you choose to give us: your name, your company or business name, your phone number, your email address, and anything you write in the free-text field. A phone number or an email address is necessary for us to reply.
If you contact us by email, WhatsApp, LINE or telephone instead, we hold the contact details and message content you send through those channels.
We record the page you arrived on and any campaign parameters carried in the link you followed, such as utm_source, utm_campaign or gclid, so that we can tell which activity brought you here.
If you accept analytics cookies, we collect standard usage information: pages viewed, time on page, device and browser type, referring website, and an approximate location derived from your IP address. We do not attempt to identify individual visitors from this data.
We do not knowingly collect information from children, and we do not ask for sensitive personal data. Please do not send identity documents, financial details or health information through this website.
How we use your information
To read your enquiry, reply to it, and prepare for the conversation you asked for.
To provide the services we agree with you, and to communicate with you about that work.
To understand which of our own marketing activities produce suitable enquiries, so that we can spend our budget sensibly.
To keep this website secure, prevent automated abuse of the enquiry form, and improve how the site works.
To meet our legal, accounting and record-keeping obligations in Thailand.
Legal basis for processing
We process personal data under the Personal Data Protection Act B.E. 2562 (2019). Where the law requires your consent we rely on the consent you give when you tick the box on the enquiry form and when you accept analytics cookies. You may withdraw that consent at any time, and withdrawing it does not affect processing carried out before you did so.
Where consent is not required, we rely on the necessity of processing to take steps at your request before entering into a contract, to perform a contract with you, to comply with a legal obligation, or for our legitimate interest in operating and securing this website. Where we rely on legitimate interest we balance it against your rights, and we will stop on request unless we have compelling grounds to continue.
Cookies and tracking technologies
Essential cookies are needed to make the site work and are always active. They do not track you across other websites.
Analytics and advertising measurement technologies load only after you accept them in the consent banner. If you decline, no analytics or advertising script is loaded at all and nothing is sent to a third party. If you accept and later change your mind, you can withdraw consent through the cookie settings link in the footer, or by clearing this site cookies in your browser.
Analytics and advertising platforms
When you have given consent, we use third-party analytics and advertising measurement platforms to understand how this site is used and which campaigns bring visitors to it. Those platforms set their own cookies and process data under their own privacy terms, and some may combine what they collect here with data they already hold about you.
We use these platforms to measure our own marketing. We do not sell personal data, and we do not upload your contact details to advertising platforms for targeting.
Service providers
We share personal data only with the service providers who help us run this business, and only to the extent each of them needs it. They fall into a small number of categories: our website hosting provider, which stores and serves this site; our email hosting provider, which delivers and stores the enquiry notifications we receive; and, where one is in use, a customer relationship management system in which we record enquiries and follow-up.
Each provider is engaged to process data on our instructions and is not permitted to use it for its own purposes. We do not sell personal data to anyone, and we do not share it with advertisers or data brokers.
We may also disclose information where we are required to by law, by a court or by a competent authority, or where it is necessary to establish or defend a legal claim.
International data transfers
Some of the providers described above operate infrastructure outside Thailand, which means your information may be stored or processed in another country. Where that happens we take the steps required by the Personal Data Protection Act to ensure the receiving country or organisation provides an adequate standard of protection, including appropriate contractual safeguards.
If you would like to know where a particular category of data is processed, contact us and we will tell you.
How long we keep your information
Enquiry records are kept for as long as we need them to respond to you and to maintain a record of the business relationship, and after that for the period we are required to keep business records under Thai law. When a record is no longer needed for either purpose it is deleted.
Analytics data is retained according to the retention setting of the platform concerned, and is held in aggregated or pseudonymised form rather than as an identifiable profile.
If you ask us to delete your enquiry we will do so, unless we are legally required to keep a specific record, in which case we will tell you which record and why.
Your rights
Subject to the conditions and exceptions in Thai law, you have the right to be informed about how your data is used, to request access to the personal data we hold about you and a copy of it, to have inaccurate data corrected, to have data deleted, to object to particular processing, to ask us to restrict processing, to request that data be transferred to another controller in a portable format, and to withdraw consent you have given.
You also have the right to lodge a complaint with the Personal Data Protection Committee in Thailand if you believe your data has been handled unlawfully.
How to make a request
Send your request to info@digitalmomentumth.com and describe what you would like us to do. Please give us enough information to find your record, such as the name and contact details you used when you enquired.
We may need to verify your identity before acting, so that we do not disclose personal data to the wrong person. We will respond within the period required by Thai law, and we will tell you if we need longer or if an exception prevents us from acting on part of your request.
There is no charge for making a request.
Changes to this policy
We will update this page when our practices change. The effective date and the last updated date at the top show which version applies. Where a change materially affects how we use personal data, we will take reasonable steps to bring it to your attention rather than relying on this page alone.
